DMCA Notice.
Digital Millennium Copyright Act
Red Chair Real Estate respects the intellectual property rights of others and expects users of our website to do the same. In accordance with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512, we will respond to clear notices of alleged copyright infringement that comply with the requirements below.
Filing a copyright infringement notice
If you believe that material accessible on or through this website infringes your copyright, you may submit a written notice to our designated agent that includes the following:
- A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
- Identification of the copyrighted work claimed to have been infringed.
- Identification of the material that is claimed to be infringing, with enough detail to allow us to locate it on our site (such as a URL).
- Your contact information, including name, address, telephone number, and email address.
- A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
- A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or are authorized to act on their behalf.
Counter-notice
If you believe that material you posted was removed or disabled in error, you may submit a counter-notice to our DMCA agent containing:
- Your physical or electronic signature.
- Identification of the material that was removed and its location before removal.
- A statement, made under penalty of perjury, that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification.
- Your name, address, and telephone number, along with a statement consenting to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if outside the U.S., for any judicial district where Red Chair Real Estate may be found), and that you will accept service of process from the original complaining party.
Repeat infringers
Red Chair Real Estate may, in appropriate circumstances and at our discretion, terminate access for users who are repeat infringers of copyright.
False claims
Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing, or that material was removed or disabled by mistake or misidentification, may be subject to liability.
